Library operating regulations

Based on the Librarianship Act (Official Gazette of the Republic of Slovenia, No. 87/01, 96/02 – ZUJIK and 92/15), the Regulation on Basic Library Services (Official Gazette of the Republic of Slovenia, No. 29/03), the Personal Data Protection Act (Official Gazette of the Republic of Slovenia, No. 94/07 – official consolidated text), Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) and the Ordinance on the establishment of the public institution Central Library Celje (Official Gazette of the Republic of Slovenia 196/2021), the Director of the Central Library Celje, with the consent of the Council of the Central Library Celje, has adopted


Library operating regulations

I. GENERAL PROVISIONS
Subject of the regulation and general
Article 1

The Rules of Operation of the Central Library of Celje (hereinafter referred to as the library) determine the types of services, membership rules, methods of using the library and its services, and regulate the relations between users, members and the library. It applies to the libraries of Celje, Dobrna, Šmartno v Rožna dolini, Štore and Vojnik, for employees, members and users of the library.
Libraries are open to users according to business hours adopted by the Library Council in accordance with the library's annual operating plan.
The language of business in libraries is Slovenian.
The masculine forms of language used in the rules apply to both men and women.

II. LIBRARY SERVICES, USERS AND MEMBERS
Library services
Article 2

The library provides and provides the following basic services:
• insight into open access library collections and their use,
• use of public library catalogues, the interlibrary catalogue, other library catalogues, databases and information sources,
• access to and use of publicly available electronic resources of public authorities,
• providing information about and from the material,
• borrowing library materials in the library and at home,
• interlibrary loan,
• training in library use,
• assistance and advice in finding materials and information and in using the library,
• getting to know new things in the library,
• copying from materials owned by the library,
• reserving library materials,
• use of book machines, computers and other technical equipment for users,
• access to the World Wide Web,
• participation in activities and events.

Library users and members
Article 3

The library can be used by members and non-members. Members are users, natural or legal persons, who are registered with the library and have a valid annual membership. By signing the membership declaration upon registration in the library, they are obliged to respect the library's rules. Members can use all library services in all units to the full extent. Users whose membership has expired and those users who are not registered with the library, the library allows the use of services for which it does not keep loan records or other records.

III. RULES OF DEALING WITH USERS
Membership – library registration
Article 4

Membership in the library is carried out on the basis of a valid personal document and a completed and signed registration form with a declaration of membership. Children or young people under the age of 15 and persons who have been granted guardianship are approved for membership in the library by their parents or guardians, who sign the registration form for them. For children or young people under the age of 15, it is necessary to see the personal document of the parent or guardian.
Young people aged 15 to 18 can register independently if they present their personal document and sign the registration form with the admission statement.
By signing the registration form, the person undertakes to comply with the Rules of Operation of the Central Library of Celje, confirms the veracity of the personal data recorded, and accepts the responsibilities arising from membership.
Members (parents or guardians) who have not settled their debts with the library may enroll their minor children only under special conditions, with borrowing restrictions.
Before enrolling, the library is obliged to provide prospective members, parents and guardians with access to the Rules of Operation and the price list (the price list is Appendix 2 to the rules).
A member who is an individual - a natural person, or a person who has been granted custody of a child under the age of fifteen (15), is obliged to provide the library, pursuant to Article 15 of the Librarianship Act:
• first and last name,
• date and place of birth,
• address of permanent or temporary residence,
• member category,
• information for notification (contact telephone number or email address).
To ensure the accuracy of data upon registration, the library has the right to inspect:
• in a valid personal document with a photo (ID card, passport, driving license) for a natural person.
• in a passport, identity card or other personal document with a photo and a certificate of temporary residence in the Republic of Slovenia for a foreign citizen with temporary residence in Slovenia.
• in the registration form with the stamp and signature of the responsible person, who authorizes a specific contact person (maximum three) for the legal entity to manage library business on the registration form. The authorized person is responsible for the membership card, and the legal entity is responsible for all violations of the rules of procedure.
The purpose of collecting the above data is to register an individual in the library so that they can use services that the library provides only to members, namely to ensure traceability of borrowed library materials, restore damaged library materials, fulfill contractual obligations related to the use of certain types of library materials, fulfill obligations related to copyright and related rights, etc. The data is also necessary to ensure statistical monitoring and transmission to state authorities and other authorized users.
With the explicit consent of the member, the controller may collect:
• information on educational level.
The purpose of collecting the above data is the need to plan the acquisition of library materials and organize services for target groups.
A member who is a legal entity shall provide the library with data accessible from public records (official title, full address of the headquarters and organizational unit, first and last name of the responsible person), and on the basis of these regulations also:
• name and surname of the person authorized to borrow the material,
• contact telephone number of the authorized person,
• contact email address of the authorized person.
An authorized person is an individual - a natural person who is the contact person and acts in the name and on behalf of a legal entity that is a member of the library.
The purpose of collecting the above data is to communicate with the person authorized to borrow materials within the framework of library services.
Membership is valid for one year from the date of registration and is renewed upon expiration or the first loan or renewal of materials. Library membership is exercised with a membership card.


Changes to members' personal data
Article 5

The member is obliged to notify the library within 15 days of any change in their residential address or legal entity address, as well as any change in their personal or contact information (email address, telephone number).
In the event of a change in personal data or data on a legal entity, the member must provide the library with access to their personal document or appropriate proof. Otherwise, they are responsible for all consequences that would arise from the library being unable to contact them. When a card needs to be replaced due to a change in personal data, the library bears the costs of the replacement.


Membership fee
Article 6

The amount of the annual membership fee for individual categories of members is determined by the valid price list (the price list is Appendix 2 of the rules), which is available in each department and is also published on the website of the Celje Central Library.
The following are exempt from paying membership fees:
• unemployed people,
• children and young people up to the age of 18, or until the completion of secondary education, but not later than until they reach the age of 21,
• members of the Celje Librarians' Association,
• disabled people with 80 % (and more) disability,
• recipients of social assistance at the proposal of the Social Work Center.
Members holding a European Disability Card receive a 50% discount on the annual membership fee.
Members who claim lower membership fees or are exempt from paying membership fees must prove their status with an appropriate official document.
The library takes into account:
• unemployment certificate from the Employment Service of the Republic of Slovenia, which must not be older than one month,
• certificate of receipt of financial social assistance from the Social Work Center with a recommendation from the Social Work Center,
• a valid membership card of the Celje Librarians' Association,
• decision on the degree of disability,
• European Disability Card,
• a valid certificate of education at the secondary, undergraduate or postgraduate level for the current school or academic year or a student ID card with a valid sticker for the current school or academic year.
The member usually pays the membership fee immediately, and subsequent annual membership renewals no later than one month after the membership fee is recorded. The library allows online payments.
The library director may grant free membership for individuals or groups, upon written request and during special events (e.g. Book Day, cultural holiday, etc.), or determine a different membership fee or terms of operation.
Library membership ends:
• at the written request of a member,
• one year after the last membership renewal, if the member is not active,
• due to gross violations of the provisions of these rules.
A person who no longer wishes to be a library member may request the deletion of their data from the library records in writing by submitting a request for deletion from the library membership records, providing a personal identification document with a photo. Deletion from the records is possible provided that the user has settled their obligations to the library in all departments. The library does not refund paid membership fees.
If the annual membership fee has not been paid and the member has not expressed a request to terminate the membership, the membership is not active. Inactive members are deleted from the library's records after one year, in accordance with the Librarianship Act. The library deletes the membership data of inactive members if they have no obligations to the library.
Membership may also be terminated due to major violations of these regulations and violations of public order and peace. The director decides on the termination of membership due to violations upon a written proposal from the head of the department. A decision is issued on this basis, on the basis of which the member is deprived of all or only some of the rights to use and visit the library for a certain period of time. In addition, the member is obliged to settle all his obligations to the library.



Membership card and membership password
Article 7

Upon registration, the member receives a membership card or a certificate for collecting a membership card. The certificate is used until the member card is received at the library. All library services that require a membership record are available to members only upon presentation of a certificate or membership card in their name. When dealing with a library where a wireless network is available, the member can also use the membership card code generated for them when logging in to My Library mCOBISS, or the card generated in mobile applications. Identification with the membership barcode is mandatory at each visit.
The certificate and membership card are not transferable to another person. If misuse is suspected, the librarian has the right to verify the identity of the holder and request the visitor to see an ID document with a photo. If a violation of the provision on non-transferability is found, the card will be confiscated. The library will notify the member in writing of the confiscation of the card.
The member is obliged to protect the card from loss, misuse and damage. In the event of loss or theft, the member is responsible for all consequences of its use until the library is notified. The loss or theft must be reported to the library immediately. In the case of a minor, the parents or guardians are responsible for this. Members are materially and criminally liable for the misuse of the membership card. The library will replace a lost, stolen or damaged card at the member's expense.
A member has the right to request a free replacement of a worn card if at least three years have passed since its manufacture.
The library can issue a maximum of three cards to legal entities that are library members.


Rental and use of materials
Article 8

The library lends and makes available for use materials that have been processed and furnished by librarians. Library materials may only be borrowed by library staff. Most materials can be borrowed for home use, but some types of materials are subject to restrictions and can only be borrowed for reading room use in the library.
Library materials that visitors wish to use in the library may only be used in the department where the material is located. Transfer to other parts of the library or to the reading room without registering the loan is not permitted.
The library does not lend rare and valuable works, reading materials that support study work in the library, materials that represent independent parts of a whole (appendices, tables, parts of multimedia sets, etc.), and the latest or bound issues of newspapers.
Borrowing is possible on the basis of a valid membership card and a valid membership. A member can borrow materials for a specific loan period, which is determined by the library according to the type of material (loan periods are published in Appendix 3 of the rules). The loan period is visible from the online catalogue and is published on the library website (Loan – table of terms). Upon loan, the return dates are printed on the library statement.
Borrowing from self-service book machines is only possible with a membership card. The member first registers their membership card or its electronic version, and then all the materials they wish to borrow at home. After completing the loan, they must log out. The library is not responsible for errors caused by failure to follow instructions and the consequences that may arise from leaving the book machine in the middle of the process and without logging out.
A member may not borrow multiple copies of the same title. A library employee may request a photo ID from the member card holder before borrowing, and upon leaving the library, the library user is also required to show the library materials, the membership card or its electronic version, and a photo ID. The member or authorized representative is required to check the condition of the materials upon borrowing and to report any damage. The librarian is required to record any damage.
Members are responsible for borrowed materials as long as they are in their name. Borrowed materials may not be loaned to other persons, even if they are library members.
Legal entities borrow materials through interlibrary loan or through an authorized contact person who identifies themselves with a membership card.
The library is not responsible for lost items of members.


Rental with authorization and home delivery
Article 9

Library materials may exceptionally be collected by a person who is not the card holder, but only with the holder's authorization. The librarian may request that the recipient see their personal document with a photo. Upon collection of the materials, the authorized person will receive an extract that would otherwise be received by the member.
For library members who are unable to visit the library due to disability, illness or age, the library will deliver the desired materials to their homes upon agreement. The selection of materials, frequency of borrowing and visiting times are coordinated between the member and the library.

Statements and invoices
Article 10

Upon borrowing, the member receives a printed copy of the balance record in the visited department (list of materials and list of outstanding obligations). The member can choose to have the balance record printout sent by e-mail. Upon settling monetary claims, the user also receives a printout of the invoice. The delivery of the printout or invoice by the librarians in the loan is mandatory. The user is obliged to immediately check whether the library printout corresponds to the actual status and to resolve any discrepancies; check the written return and extension deadlines, list of borrowed and reserved materials, recorded claims, etc.). The library does not consider later complaints. The invoice must be collected and kept immediately after leaving the library.
A member may order a special printout of data on their past library loans for their own needs. Due to the protection of personal data, a printout is only possible after prior agreement with a librarian and upon additional identification with an identity document. The member pays the cost of the printout according to the price list (the price list is Appendix 2 to the rules).
An individual may request access to personal data in order to obtain information about their own personal data, which is completed with the purpose of providing information about which personal data is kept in the library for an individual natural person and how it is processed. In order to provide information about personal data kept in the library, the applicant must submit an identification document, from which it is evident that they are actually the person for whom the personal data is requested to be disclosed or provided. In the event that the applicant is an authorized representative submitting a request on behalf of another person, in addition to their own identification document, they must also submit an identification document and authorization of the person for whom the personal data is requested to be provided.
The library provides individuals with free access to requests for exercising individual rights prescribed by applicable regulations in the field of personal data protection. The library has published more detailed provisions regarding the exercise of individual rights on its website and posted them in its premises.
The library must respond to requests from individuals exercising their rights in relation to personal data without undue delay and no later than one (1) month from receipt of the request. The deadline may be extended, if necessary, for a maximum of two (2) additional months, taking into account the complexity and number of requests. In such a case, the library will inform the individual of the extension in a timely manner, together with the reasons for the delay.



Extension of loan terms
Article 11

The loan period is usually extended before the end of the term. Extension is possible if the material is not reserved or does not have a programmatic extension limit (e.g. material under a third overdue, certain journal titles).
In the event of high demand, the library may set a shorter loan period for any title and/or temporarily suspend the possibility of extending the loan period.
Renewals can be made when visiting the library, or independently at self-service book machines, the COBISS/My Library web application, or the mCOBISS mobile application. All methods provide feedback on the success of renewals and new return dates. If renewal is not possible, the member must return the material on time.
Telephone renewal in the library is intended for cases where a member is unable to renew independently due to a long delay, reminder or membership expiration. The library performs the renewal based on their membership number. If the member's membership extension prevents the expiration of the membership, the library also extends their membership when extending the loan periods and records the appropriate annual membership fee, and also checks the member's contact information. The library does not accept complaints about renewals made on the basis of a personal telephone call to the library and requests sent to non-designated addresses; the member is obliged to verify the success of these extensions as soon as possible.
The library does not extend the waiting period for pending reserved materials and the time it gives a member to replace damaged, missing, or lost copies.


Library material reservations and notifications
Article 12

A member can reserve materials via the Internet in the My Library program or with the mCOBISS mobile device application, always identifying themselves with their membership number. They can reserve free or borrowed materials. When reserving borrowed materials, they are placed on a waiting list. They can reserve materials if they have a mobile phone number and/or their email address registered in My Library, so that the library can notify them of the arrival or preparation of reserved materials by email or SMS. The member must ensure the accuracy of this data and the accessibility of the selected notification method. They must collect the waiting materials in a timely manner or cancel their collection in a timely manner.


Return of borrowed materials and other returns
Article 13

Borrowed materials are usually returned by the member by the end of the loan period, during the library's opening hours. Materials can be returned without a membership card. Returns are also possible at the self-return machine outside of opening hours. Any malfunction of the machine outside of library opening hours is not a reason for a complaint.
Materials that members submit to the library for various reasons (for possible replacement of lost or damaged materials), or damaged and already written off library materials that members have appropriately replaced or paid for, are returned or handed over to members by the library. They can collect the materials within an agreed period, but no later than one month. After this time, the library is no longer obliged to store these materials.


Electronic member notification and accountability
Article 14

Members can independently subscribe to various electronic notifications in "My Library" that help them keep records. Three notifications are set by the library itself upon registration: notification of the arrival of reserved materials, notification of outstanding claims and notification of membership expiration; a member can also request changes to the settings when visiting the library. For minors and persons assigned guardianship, the addressing of these notifications is determined by parents or guardians. The library and its partners cannot ensure completely reliable notification. Notification failures that are not caused by the library's website, but are the result of network outages of operators, power outages, or various technical malfunctions cannot be the subject of complaints.


Overdue loans and debt repayment
Article 15

If the member does not return the material on time, a daily late fee will be charged for each borrowed unit of material. In the case of borrowing sets, the unit of material is the set.
The library collects unpaid materials by sending written reminders by mail. It sends three reminders in succession. The library issues the first reminder on the tenth day after the loan period has expired, followed by the second and third reminders at intervals of fourteen days. The third reminder is sent by registered mail. For minors and persons granted guardianship, reminders are addressed to parents or guardians. Each reminder contains a printout of the unpaid material and the date of its loan, as well as the price of the reminder and the daily late fee and late fee calculated on the day the reminder is issued. The costs of the late fee and reminders are added together. The member is obliged to review the printout on the reminder and immediately notify the library of any comments. The library does not consider subsequent complaints.
A member who has received a third reminder cannot do business with the library until they return the borrowed materials and pay the late fees.

A member can no longer use library services if:
• the total claims exceed an amount determined by the library, or
• receives a third warning or
• has recorded library receivables that are older than 45 days.
If the member fails to return the borrowed material within thirty days of the third reminder, the late fee will be suspended. The library will hand over the claim to an authorized collection agency.
Debts to the library, which are expressed only in money, are recoverable even without prior reminder. The recovery is charged in accordance with the price list of the authorized recovery organization. For the purposes of recovery, the personal data of users are processed in accordance with the legal provisions on the protection of personal data.
In exceptional cases, the library may allow a member to settle claims in several installments or write off a claim based on a written request addressed by the member to the director.


Damage to materials and equipment, loss and replacement of materials
Article 16

A library member is obliged to protect borrowed materials from damage, destruction or loss.
When borrowing, the member is obliged to check the condition of the material and alert the librarians to any visible damage or missing parts.
In the event of damage to the material, the member is obliged to pay the cost of repair.
If the repair of damaged material is not possible or if the member has lost the material, the damaged or lost material must be replaced with a new one or compensation must be paid in the amount of the purchase price of the material. The replacement material or compensation shall also include the costs of professional processing and equipment according to the library's price list (the price list is Appendix 2 to the rules). The library shall determine the price of irreplaceable material.
If a member loses or damages part of the material in the kit, they are obliged to replace the lost or damaged part or reimburse the cost of the entire kit.
If the member fails to replace or settle the damage or loss of the material within thirty days of discovering the damage or loss, a claim for compensation will be filed against him.
A member may not repair damaged library materials themselves.


Information about library materials
Article 17

Members can search for information about the material in the COBISS computer catalogue, accessible via the website of the Central Library of Celje or the mCOBISS mobile application. Members can also receive brief information about the availability of the material by phone, e-mail or sikce@knjiznica-celje.si or at the library service "Ask the Librarians".

Reproduction of library materials
Article 18

When reproducing materials, the library complies with the Copyright and Related Rights Act. It only reproduces its own library materials to its members, and to a limited extent. It does not reproduce some materials. Photocopies and other reproductions are charged according to the library's current price list. The library is not responsible for reproductions that users make themselves.



Interlibrary loan
Article 19

Materials that the library does not have can be ordered through interlibrary loan. The service is intended for the exchange of professional, educational and study materials. The costs of interlibrary loan are charged according to the valid price list (the price list is Appendix 2 to the regulations). The return deadline and extension of loan periods for materials borrowed from another library are determined by that library. For members, this loan period is shortened due to sending by mail. The library charges the ordered materials that the client does not collect as a realized interlibrary loan.
Interlibrary loan of materials between public libraries in the Celje area is carried out in accordance with the signed agreement on the implementation of interlibrary loan in the area. The public libraries in the area are: Anton Sovret Library Hrastnik, Laško Library, Mozirje Central Library, Rogaška Slatina Library, Slovenske Konjice General Library, Šentjur Library, Šmarje pri Jelšah Library, Tone Seliškar Library Trbovlje, Velenje Library, Mile Klopčič Library Zagorje ob Savi and the Intermunicipal General Library Žalec.



Use of computers
Article 20

Library visitors, members and non-members, have the right to use computer equipment owned by the library and access the Internet via the library network.
In accordance with the rules of use of the Arnes academic network, the library is obliged to keep records of everyone who connects to the Internet on its network. Therefore, before using computers and the Internet, non-members are required to submit a valid personal identification document with a photo to obtain a password, while members register with their ID number and membership password.
The library restricts and prohibits public access to inappropriate and security-risk online content. It prevents access to library computers to violent, hateful content and pornography, and does not allow the use of library computers for hateful communication. The librarian may request that a visitor stop viewing inappropriate online content.
The library also restricts the use of non-members and minors in terms of time and space. The library is not responsible for misuse of library computers by its users, but rather the users themselves, both criminally and materially.
The use of library computers and the wireless network is defined in more detail in a special library policy, and the payable items are defined in the library price list (the price list is Appendix 2 to the policy).

IV. RIGHTS AND DUTIES OF THE LIBRARY TOWARDS USERS AND MEMBERS
Library duties towards users and members
Article 21

Library staff are obliged to treat users in accordance with the Rules of Business. They must comply with the applicable legislation on the protection of personal data and ensure the protection and confidentiality of data that members provide to the library upon registration or later for the purpose of membership records. They are also obliged to respect the legislation on the protection of copyright and related rights. Librarians follow the Code of Ethics of Slovenian Librarians in their work and conduct. They are polite and respectful towards library users, and they expect the same from visitors.
In order to protect the privacy of users of library services, the library has adopted a decision to appoint a Data Protection Officer (DPO), who performs advisory and supervisory tasks in the field of personal data protection. The library has publicly published the contact details of the authorized person on the website of the Central Library of Celje and posted them in the library premises.


V. BEHAVIOR IN LIBRARY PREMISES, SANCTIONS
House rules
Article 22

Library visitors must handle computer equipment and other library inventory responsibly and take care of their personal belongings. Their behavior must not interfere with work or study.
It is not permitted to bring luggage or intoxicating substances into the library premises. It is not permitted to consume food and drink when using library materials and equipment; the use of non-alcoholic beverages in sealed containers is permitted, but the member must be careful not to spill any on library materials or equipment. Loud talking and shouting, verbal violence and other violent behavior and conduct, indecent behavior, violation of public order and peace, use of mobile phones in the reading room and other rooms for learning and study, entering with roller skates, skateboards and other means of transportation are not permitted in the library.
The library is not responsible for the theft or loss of personal property.
Library employees are obliged to maintain order that is consistent with the intended purpose of the library premises. Members and other visitors are obliged to follow the instructions of employees. For children, young people and persons assigned to them as guardians, the responsibility for the safety and behavior lies with their parents or guardians.
In the event of violations of these rules and regulations, the employee may warn the visitor of the violations. If the violation continues, the employee may request that the visitor leave the library. The employee may then call security or the police, who will remove the violator from the library.
The library restricts the use of services to members who repeatedly violate the rules and regulations. The choice of restriction (oral and written warnings, temporary bans, loan restrictions, equipment use restrictions, exclusion from membership) depends on the type of violation and is aimed at preventing a repeat of the violation. In the event of exclusion from membership, the library does not refund the paid membership fee. The member is notified of the exclusion in writing.



VI. SPECIAL PROVISIONS
Complaints about library transactions
Article 23

The library resolves complaints based on recorded program transactions and statements. Complaints about unsuccessful telephone and online transactions (renewals, reservations) cannot be considered (see Article 12).


Gifts
Article 24

The Central Library of Celje receives material as gifts from individuals or institutions. By accepting book and non-book donations, the library does not commit to including the material in its collections. The selection is made independently, based on professional judgment and in accordance with its purchasing policy.
The library accepts donated library materials on its premises. The donor signs a statement in the library confirming their ownership of the donated material and their agreement with the library's further handling. The handling of donations is regulated in more detail in the Rules on Handling Donated Materials.


Security of materials and equipment
Article 25

The library electronically secures its premises, equipment and materials with video surveillance and an audio and alarm system. In the event that an audio alarm is triggered to protect the materials, library users are obliged to cooperate with employees in discovering and eliminating the reason for the alarm.
In accordance with applicable personal data protection regulations, the library keeps records of persons who have codes for the alarm system and records of video surveillance. The library director and the building manager have access to the video surveillance system.
The library regulates video surveillance in more detail in its internal act on personal data protection.

Taking photos and recording, publishing footage, carrying out promotional and other activities
Article 26

The library photographs and/or records all public events held on its premises and uses the photographs and/or videos for publication on its website, in its promotional materials, or for other reasonably similar promotional purposes.



Library clarifications, dispute resolution, complaints and requests
Article 27

Users receive various current explanations regarding library procedures directly from library employees. Current complications are resolved by users in the loan office or with advisors in the departments. In case of dissatisfaction and misunderstandings, they can contact the head of the department orally or in writing or write their comment or opinion in the Book of Criticism, Praise and Suggestions, which is available in all units.
If the user is not satisfied with the proposed solution of the unit manager, he or she may submit a written application or complaint to the library administration. The library director or a person authorized by the director is responsible for resolving written applications and complaints. The library shall respond in writing to the application or complaint within thirty days.


VII. FINAL PROVISIONS
Validity of the policy
Article 28

The Rules of Operation shall be valid from 1 January 2025. On this date, the Rules of Operation of the OKC No. 0-213/2023, which were valid from 1 January 2024, shall cease to be valid.
